Open Forum “The role of Constitutional Court in Promoting the State of Justice in Kosovo”
Due to the initiative “100-years justice” and due to the European day, students of law department organized an open forum with the topic: “The role of constitutional court in promoting the state of justice in Kosovo” with their special guests Head of Constitutional Court of Kosovo, Prof. Dr. Enver Hasani and members of this court.
Mr. Hasani introduced students with the challenges and reforms that constitutional court of Kosovo faces in order to consolidate a legal state there. He told that the institution he directs plays a vital role in order to protect the Constitution of Kosovo. He told also that this institution is the last place were the citizens believe that their rights will be protected.
President of Constitutional Court of Kosovo, after making a brief review of the historical events that take place in the development of the constitutional court, said that the modern constitutionalism in Kosovo sanctioned and implemented only after the independence, 17 February, 2008. After that date Kosovo enter into the road of institutionalization and the basic constitutional institutions of an independent and sovereign state were founded. He cited a number of important decisions which had influence in political and institutional life of state of Kosovo like the case of decisions about former president Fatmir Sejdiu and the case of declaring unconstitutional election of Mr. Behgjet Pacolli as president.
Then he said that the Constitutional Court of Kosovo, from the foundation till now has a deserved place in the constitutional system and has not faced any case of failure to comply with its decisions, even thought there is no guarantee to its implementation. According to him, Constitutional court of Kosovo will not only be guardian of the Constitution, but will actively intervene in ensuring the separation of powers and the supervision of constitutional quality of laws.
